Are new home swimming pools covered by california's construction defect law? Would new pool after home completed be covered?

It kind of depends upon which law you're talking about, but pools are covered by a number of defect laws.
While there are lots of laws and cases about construction defects, I assume you mean SB800 from 2002, which is codified as California Civil Code sections 895 through 945.5. If the swimming pool was built as part of the entire work of improvement of new residential constructon, it would be covered by that law. If it ws built after the residence was completed it would come under home improvement laws, and the special statutes regarding swimming pools (some of which would apply to a pool installed when the home is built as well).
