Legal Question in Construction Law in California

our house was new when purchased one year ago 2009 in Salton Sea Ca. this year 2010 the sepitic tank collapst and the house in now inhabitable. the contractor or verdor have disapeared can we get help.

You can (and probably should) sue your contractor but If your contractor did not have any insurance, you may not be able to collect anything. Your best bet may be to get your homeowners insurance to pay and to let that company go after the contractor.

The Imperial County building permit office will have records, available to you for a small fee, which will contain useful information for tracking down the builder and identifying its bonding company. Also, most lawyers have the ability to trace persons and businesses that have disappeared. Sorry, names cannot be mentioned on LawGuru. Your biggest problem is likely to be the builder's financial condition after you find it.

The builder most likely subcontracted the septic. Follow the advice of the other attorneys to use the bulding dept. to find out who the subcontractors were. They may still be around and able to answer for the problem. You can try your homeowners insurance, but don't count on any success. Construction defects are excluded from coverage 99.9% of the time.
