Legal Question in Construction Law in California

The landscape contractor I hired made a mess of my backyard. I hired another landscape contractor who is well known and respected in the industry to inspect the job and his written report to me confirms the mess. Am I under obligation from the State Contractors Board and the contractors surety company to give him a chance to fix the problems? My problem is that I have lost all confidence in his honesty, knowledge and ability to do the job correctly. Additionally, his verbal assaults have created a hostile and stressful working relationship that is unbearable. Thank you for you help.

The answer is best searched for first in your contract with the original landscape contractor. Often there will be a clause in construction contracts requiring notice and an opportunity to cure. If not, you can put him on notice of the problems and advise him of the cost to repair and demand the money back. If he doesn't pay, your options are to let it go, file suit and/or file a complaint with the contractors state license board.
