Legal Question in Construction Law in California

Lawer against construction comopany

Hi,

I'm a contractor that recently had done a project for a lawyer, I completed the entire project, received a final approval from the inspector. And the lawyer that I was doing the job for decided to cancel a check. He told me he needs to finish really fast, so he handed a check to me and canceled it. He had a plan, he gave me a check to keep me working and canceled it, but the final check went thru. After a couple of months he decided to saw me for the entire amount of the project $25,000. I came to court, but they told me that I need to get a lawyer and that I will be receiving a notice from the court when to come. Never received anything. So I decided to go to a lawyer just to check the status, I he told me that I had lost the case for the entire $25,000. I have 2 companies, He is trying to take the bond for $12,500 from each company. I am really stuck!!! what can I do.

It sounds like a default judgment was entered against you. A defeault is a judgment entered against a party that does not appear. While they are certainly legal, they are disfavored and if certain criteria are met, they can be set aside and the case can proceed.

I recommend you hire an attorney. First order of business will be to prepare a motion to set aside the default.

If you are serious about pursuing this, feel free to give us a call.
