Legal Question in Construction Law in California

I missed my 90 day deadline for filing a foreclosure on a mechanic's lien. Can I still sue for failure to pay for services rendered using a different instrument of the law. (the amount is over 8k)

Absolutely, provided you are a licensed contractor. The 90-day deadline is only for the extreme remedy of a mechanics lien. Any other cause of action you would have in any other business transaction for goods and services is still available. Two years on an oral contract, four on a written contract, three on fraud, etc.
