Legal Question in Construction Law in California
Owner's rep is asking for a unconditional progress release from a sub even though no invoice was submitted for the month and or the sub has not even started working on the project. Do I need to get a release?

If the sub has given the owner a 20-day notice, the owner is entitled to a progress release to assure there is not unpaid work that started since the last progress payment. To avoid this in the future, you should work with your subs to encourage them not to send their preliminary notices until 20-30 days before their part of the job starts.
