Legal Question in Construction Law in California
I paid a contractor $1200 in advance for material (tile) to remodel my bathroom. He skipped out and never did the work. I later found he is unlicensed. He lives in Ventura county California. My home is in Los Angeles county. In what county would I file a small claims action.?
I have contacted him via certified mail regarding my intentions to take this to small claims. My letter was returned by the post office.

You can file in either County. Your choices are to file in the County in which the Defendant (the tile guy) resides, or where the contract was entered into and the work to be performed. I am sure it goes without saying, but you will want to check the status of contractor's licenses before hiring them in the future. It is not a guarantee that they won't also stiff you, but at least then you have the Contractor's State License Board and the contractor's bond to go after if they default. Good luck.
