Legal Question in Construction Law in California
Period of builder liabilty for defective construction
I have wood rot from water damage in front part of my house, primarily decks . It is 23 years old and on the ocean front.. My contractor had a ''expert witness '' type structual engineer review problems and he seems to think because the lath and plaster was not done right that I have a case due to faulty construction..they want me to authorize them to drill holes all over the house looking for trouble..Is there a statue of limitations on builder responsiblity in California? I have little interest in litigation and would like to just get the deck job done amd move on.
Thank you,

Re: Period of builder liabilty for defective construction
The longest statute of limitation for construction defects in California is 10 years. I'm surprised your contractor didn't know that and I would be wary of using someone who makes their living as an expert witness.
