Legal Question in Construction Law in California
I recently bought a home which part of our request for repairs stated the HVAC would be replaced by an HVAC contractor. 4 months later I go to work it and it will not get cold. It appears there is a leak due to bad installation/parts. I have been told CA law requires licensed contractors to have a warranty on their work, is this true and would it apply to me since I didn't own the home at the time of purchase? The seller refuses to tell me who worked on it so I believe they may not have had a contractor do the work as they stated.

It is true that there is an implied warranty. Here's an excerpt from an answer I wrote a couple years ago in response to a similar question:
"You can find a pretty good beginning introduction to California contractor warranties on line at http://www.professionalhomeinspection.net/pdf/contractor_law_1-4-10_yr.pdf
Basically, it tells you that the law requires a licensed contractor to provide one year, four year and ten year warranties. Each warranty covers fewer types of claims. You should be covered by the four and ten year warranties."
Hope this is helpful.
