Legal Question in Construction Law in California

We are trying to terminate a contract that automatically renews every three years. The contact will roll over again in May 2010. We faxed a notice in January 2010 to terminate contract giving more then 60 day notice prior to the renewal term. They said they never saw it. Now we are past the 60 days by two days so they say we have to pay the 60 day term plus 6 months monthly fee since we will be into a new three yr term. Is there any way to prove they received the notice with more then 60 days?

Didn't you keep the fax transmission report? If you have that it should prove the fax went through. Then just refuse to pay them.
