Legal Question in Construction Law in California

Is it true that a contractor can ask for more than 10% down if it for materials rather than labor if those materials are delivered to the commercial site before the job start? I have a vendor that is asking for a 40% advance to redo fiberglass decking for my apartment complex, 69 units.

Contractors can bill for materials once delivered to the job site. That is not considered part of the down payment.
