Legal Question in Consumer Law in California

Do I have an actual small claims case or personal liability case? Limo/Party Bus hired for 28 Seniors to be taken to their Senior Prom at the Queen Mary Long Beach Calif., they were to be picked up at 5pm for a 1hour photo session at Dos Lagos Outdoor Mall Corona, then onto the Queen Mary. Never did the limo arrive, with several calls to the owner Sal, he told alot of lies for about 1hr 1/2, then we started to panic, tried to find enough rides for everyone to meet up w/limo bus in Ana Hills, by 7:45pm they were getting on bus, driver stated he didnt work for the company, he was hired as a favor, another lie he was owners son-in-law, unlic driver, the company also their lic was susp by the state puc 1 week before they took our order, he had no lic no liab ins and was not legally able to drive the bus. They did not arrive at dance until after 10pm, the sr photographer left at 10, no photos again, only could they enjoy the dance for 1hr. We are out alot of time and money and there are no do overs, he stated go ahead and sue me I will win, Im out alot of money as well.

You appear to have an excellent case, but Small Claims Courts often give little or nothing for emotional distress. You should go and watch several hearings to see what the judge who you will be assigned to does as to damage awards.You will need proof of your damages, etc. The limo company is negligent for not picking you up on time, providing an unlicensed driver, getting

you to the party late, missing photos, etc..
