Legal Question in Consumer Law in California
Alleged double-billing by Hospital
I was double-billed by an Anaheim hospital for physician fees that had already been paid separately. The hospital did not present me a proper bill for the amount in dispute, but only added the amount by hand to an invoice they sent me. Despite repeated attempts to get an explanation for the extra amount none was given. All bills were paid in full by my insurance carrier (excepting the amount in dispute).
About 4 months after all bills paid, I was contacted by a collection agency for the hospital. After 2 further months of correspondence, the hospital accepted that they had tried to double-bill me, and apologized. I demanded compensation for the distress caused to me and my reputation. They refused anything beyond an apology and an offer to let me keep $200.00US that was paid out in error as a refund by the physician's group. I refused it.
I do not live in the United States, I want to get a local lawyer to deal with this, on a contingency basis. Have I a case to demand damages?
I also suspect that the hospital makes these billing errors on a regular basis, and am curious if anyone would want to handle a claim under the False Claims Act.
