Legal Question in Consumer Law in California
Amending Contract
My son purchased a used SUV April 2005. I co-signed. We were just notified that credit cks were run on both of us, the loan has been given to a new company, due dates & interest rates were changed all w/out our knowledge. The new loan is in my name only, but my last name is incorrect on the new loan. This is the 2nd time I have had to clean up my credit report for misinformation being submitted to the various credit reporting agencies by this car dealership. Can this dealership change the contract mid stream, and sell the loan? I don't want this vehicle in my name. I've tried contacting the local better business bureau, but they are not listed. I need some guidance on how this matter can be resolved.

Re: Amending Contract
A lender cannot unilaterally change the terms of the loan unless you agree to the changes. You should contact a local attorney to reveiw the contact and then send the loan purchaser and the dealership a very stern letter objecting to the changes. If they do not back down, legal action may be necessary.
