Auto Accident Repairs Delay - claim against Ins Co
I rear-ended another vehicle. Car in repair shop since 7/14/04. Repairs partly completed, appears as if shop not working on repairs. Communicated many times to 21st Century but they are doing nothing.
Car towed to shop by tow company coord by 21st Century, I asked to be towed to 21st Century approved shop but 21st Century claim it is not approved shop when I started having delays.
21st Century already paid repair shop. I did not authorise payment and did not know about payment until I started running into delays. I believe repair shop is giving me run-around because 21st Century paid them.
Since no progress on repairs I repeatedly asked 21st Century to tow car to another (21st Century approved) repair shop to have repairs completed, but they are stalling claiming check already cashed.
I do not have car rental coverage and am paying my own which I believe is why 21st Century is not resolving this.
Recently I sent letter to 21st Century saying I will seek attorney, got reply from a new rep who said the original rep I was dealing with is no longer available.
He also claimed a two-party check was issued. Since I did not endorse the check I do not see how it could have been cashed as several 21st Century rep claimed.

You may have an action against both the repair shop and your insurance company. Loss of use is damages which your policy should cover. Call me directly at (619) 222-3504.
