I bought a car 2 years ago from my dad's gf. When i tried to get it smogged i find out it needs a lot of work to make it pass.

Aren't there lemon laws? and laws that prevent someone from selling a car without a smog cert?

When i initially showed interest in the car she said everything was fine. She told me when i tried to smog it (a year and $1000 later) that the last time she tested it the guy told her it wouldn't pass next time. I wouldn't have bought it until she got it smogged.

Now you know why California law requires the seller to smog the car BEFORE it is sold. At this point, you could go to small claims court to ask the court to refund your money or the money it is going to cost you to have the car pass smog.

If you want to rescind the sale, you would need to hire an attorney and go to superior court.
