Auto Repair Liability
In Jan. 2008 I was in an accident
where I rear ended another vehicle.
The vehicle was purchased brand
new in 2005 and has never had any
issues whatsoever. April 2008 I
finally got the car back from the
bodyshop recommended by the
insurance company after over 3 long
months of waiting. That same day
and approximately 30 miles later the
transmission goes out while driving
on the freeway. As I pulled off the
freeway onto the shoulder I noticed
that my hazard lights weren't
functioning. It was scary being on a
narrow shoulder hoping that I
wouldn't get hit by another motorist
as I waited for a tow truck because
they didn't see my vehicle. First, I'm
concerned with the mechanical issue,
which hadn't been present prior to
it's repair at that facility. Secondly I
am very concerned that the body
shop released my vehicle to me
without the hazard lights properly
functioning. What should I do and
how should I go about it?

I would take it to a body shop of my choice, have them write a detailed report, and then -- before any work is done -- have them contact the insurance company and explain the situation and let them take photos and inspect the car. I wouldn't take it back to the same body shop that made you wait 3 months. What a nightmare!

You need to have a mechanic inspect the car to determine if the transmission and hazard light problems were caused by the accident.

You might consider taking it to another repair facility and have them do a full analysis.
