Legal Question in Consumer Law in California

Automobile Military Clause

Is there such a thing as a law or a ''clause'' that states that when a military member gets orders overseas as to Japan or outside of the Continental U.S. that a military member who has a car loan out can do something about it, i.e. turn the car in with out any type of bad credit marks or other wise something that hurts me in any way. Also if there is how does it work or where can I find information of this matter.

Thank you.

Re: Automobile Military Clause

You should check the Soldiers and Sailors Civil Relief Act to see if that federal law provides for this type of relief. If you are currently in the military, I would suggest talking with a member of the local Judge Advocate General's office.

The Soldiers and Sailors relief Act should prevent a lawsuit from occurring while the serviceman is in the active military. However, I am not sure if the Act would prevent adverse credit reporting. You should check with an attorney before letting the loan go into arrears.
