Legal Question in Consumer Law in California
breach of contract
The hotel I booked a wedding reception ballroom with has just informed me that the room will not be available because of renovations. I get married in 13 days! I signed a contract for my ballroom back in Oct. 2002. Can they get away with this?
I want the hotel to reschedule the renovations until after my wedding.

Re: breach of contract
You will have to look at the contract to see if there are any provisions that cover this situation. If not, then they have to cover the additional expenses.
Re: breach of contract
They can get away with this if you let them. Based on information provided thus far, they are in breach of contract. First things first. Confirm, if not already done that your first location has no alternative remedy. If none, find another location for the wedding, etc. After all clears, think of pursuing action for breach of contract. Must have losses. If under $5,000.00, file small claims action. Re: breach of contract
based on the facts u have submitted thus far, the hotel's breach appears to be without merit or legal excuse. thus, based on your facts, you would have a duty to try to mitigate the damages by booking a new venue for your wedding, and the hotel that is in breach now would be liable to you for any out of pocket costs you incur in doing so, especially if the new venue is more expensive than the hotel's price given at the time of contract. if you would like further assistance in this matter, feel free to email me directly with more details and your contact information.
