Legal Question in Consumer Law in California
Breach of contract
I joined a health club in September, 2002. I was told the club would open in October, then in November, then in December, then the first weekend of January, 2003. The club has yet to open. I signed a 1 year membership. I paid enrollment, first and last month membership dues. The contract only gave me 3 days to change my mind. I feel that the club has failed grossly to fulfill it's obligation to me.
How can I legally cancel my contract without any penalty and can I request my money back?

Your best bet is to sue the club in small claims court. This will also cancel the contract.
