Legal Question in Consumer Law in California
Breach of Contract?
My situation is: My wife and I got married on Feb. 10 of this year. We hired a studio to take pictures and video for our wedding days. We had a contract with the studio for about $2800. There is no written contract for when the albums and the dvd will be ready but through verbal agreement it will be ready in 3 months. It's been more than 3 months, so I went to the studio to find out why no one contacted me for my pictures and dvds, I found that the studio is closed for good and I don't know where the owner's about. Anyhow, I was able to call one of his phone line and had a long conversation with him. He promised to send the pictures and dvds but it'd been more than 2 weeks with many messages I left him but no reply. My question is, can I sue the ower in court? I live in San Jose, California. Is there any special laws? How am I going about find out who's the real ower and where he lives so that I could file a lawsuit?
Thanks very much,
Jimmy

Re: Breach of Contract?
You can sue the company in small claims court. If it is a corporation, you need to serve them with the agent for service of process listed at www.ss.ca.gov
However, if it is an individual, you need to go to the county to determine who has the business license.
You can get my free ebook on small claims court by emailing me at [email protected] and asking for it.
