Legal Question in Consumer Law in California
buisness deal gone bad
I had two vendors selling me shutters for my house. Both gave me the same quote for the shutters but each one used a different material. After I made my decision the shutters were installed minus 3 windows. When I asked about the 3 windows they said they made a mistake and had forgot about ordering them but stated they never charged me for them. Now they say if I want the 3 shutters I'll have to pay x-tra. I have not paid them in full and feel it would be right to deduct the amount it would cost me to have to get those 3 shutters made. The vendor states that since they never charged me for the shutters i should have to pay if i want them made. The original verbal agreement (To which they acknowledge) included all of the windows of my house to be covered. Had I known it would cost x-tra, I would have gone with the other vendor that would have done it for the agreed upon quote. What do I do?

What does the contract say? It should list a number of windows and a price for each. If the contract does not include those 3 windows, then you owe them extra. If the contract does include those three windows, then you do not owe them extra.
