Ca-Gift Certificate

Travelocity offers a gift certificate for

there �Last Minute Travel

Packages�, according to their site

�Last Minute Packages Gift

Certificates are only redeemable for

Travelocity Last Minute Packages

and not valid on other Travelocity

products. Gift certificates and

unused portions of gift certificates

expire one year from their date of

issue.�

We live in Ca. and purchased one of

these Gift Certificate but never had

the chance to use it. It was lost

and recently found, it�s been 7

years but a friend of ours told us

that Gift Certificates cannot have

expiration dates unless they follow

under one of the Ca. exceptions

which we don�t believe it does.

My question is:

Are we out of luck? Or do we have

a leg to stand on and should argue

with Travelocity that they must

honor this certificate?

Have you contacted them? Have they already refused to honor it?

Two critical issues:

1. Is it truly a gift certificate, within the meaning of the statute? (As opposed to a promotional credit they issued?)

2. Was it issued in California and/or is is subject to California law?

Generally, put the ball into their court. Tell them you believe gift certificates may not expire in California. Perhaps they are familiar with the issue and will provide you with a detailed explanation as to why they think the expiration is not a problem.
