Legal Question in Consumer Law in California
used car
we bought a used car as is from a dealer that stated in writing that the car was in ''excellent mechanical condition'' They took me across the street to pep boys and gave the car a pass on everything. When we got the car to the audi dealer he gave me a list totalling 6000 to fix it. They also gave us a kelly blue book suggested retail as the car was in excellent condition, We took the car to an audi mechanic and he charged us 3600 to fix the problems...now the transmission is slipping. I am talking to pep boys corporate and I called the dealer. He hung up on me twice. Is it possible to sue them?

Re: used car
You bought it "as is," so no lawsuit.
Lesson: Don't use the mechanic across the street from the used car dealership to inspect the car.
Re: used car
That other answer you got seems a bit hasty -- the question is whether the written term "excellent mechanical condition" becomes a warranty. Another question is whether the conditions are so obvious that "excellent mechanical condition" was a fraudulent misrepresentation to get you to buy the car -- do you have any info from Pep Boys that shows you took it there - and did Pep Boys examine the same things that your Audi dealer looked at -- feel free to send me more details to my email below -- I'd need to dig a bit more, but this reminds me of a car case I handled some years ago. . . you might have a claim.
