Legal Question in Consumer Law in California
Does a used car dealership have to tell you if there was a milage rollback?
Hi. i bought a 1992 lexus es300 from a dealer in so. ca.
Since then its fallen apart. aftger investigating the cars history i found out that the car had a milage rollback of 21k miles back in 1995. the car has gone through 5 sells from auctions since then, and since i bought it the anti lock braking system went out and the transmission went out.
they fixed thy transmission because it was under a month warrenty (thank god).
So i guess my question is ....Did the dealer have to tell me about he milage rollback even though it wasnt them that rolled back the milage?
Can someone please answer this question and tell me where it states it at...(vehicle code...etc...)
Thanks for any response in advance.

Rolling back the odometer is a violation of Federal law as well as State law. You could conceivably be able to "revoke your acceptance" of the vehicle based on this. You can search California law at www.leginfo.ca.gov. You might try consulting with one of the law firms that specialize in lemon laws, even though the lemon laws only apply to new cars you might get some good advice. But it was an old car when you bought it. Next time buy a carfax report before you buy a used car.

I have previously handled an odometer rollback case. Depending on the facts of your case, I might take it on a contingency basis (no recovery = no fee).
Best of luck,
