Legal Question in Consumer Law in California

used car purchased fron private owner

I asked the owner specific questions to establish what the 'as is ' condition of the car was before I agreed to buy. Almost everything discussed (brakes, battery, fluids) was not so. I had to buy a new battery as the battery in the car at purchase died the very next day, I had to replace all fluis as they were dirty and the radiator had rust in it. I had to buy front and rear brakes as they were about to hit metal in a week after i bought the car. The Service Engine' light came on after driving the car only 1 day and I had to replace both 02 sensors to clear the code AND I had to smog the car. I spent nearly 900.00 in the first week of ownership in order to be able to drive the car and smog it. I called the prev owner...they laughed at me.I had asked them to reimburse me. Is small claims going to help or am I out 900.00? I spent 1000.00 on the car (a 1998 Mercury Tracer)The owner and I did sign a contract that stipulated the owner ''promises no major motor problems for 1 year after date of sale. I bought the car 4/13/07.

Thank you!

Re: used car purchased fron private owner

If the seller made representations to you about the quality of the vehicle which turned out to be false, you should file a small claims action.
