Legal Question in Consumer Law in California

Cell Phone Contract Question

I switched to Verizon as my cell phone provider last May and for 5 months have

been regretting that decision. I've spent hundreds of dollars and countless

hours on their customer service line in order to fix mistakes that THEY have

made. I've made notes describing the problems I've had with them during this

time and have done my best to get all the names and dates correct. Without

getting into details it has a major hassle and horrible annoyance. As I feel they

have not lived up to their part of the contract I wish to end my relationship with

this corporation but do not wish to pay their ''early termination fee.'' Do you

have advice about what rights I have as a consumer and how best to keep my

credit from being affected?

Re: Cell Phone Contract Question

It is hard to give specific advice without getting into the specifics of why you believe that have breached the ccontract. Unless you reach a negotiated settlement, they will bill you for the early termination and would most likely send it to a collection agency if you didn't pay. To protect your credit rating, you might consider filing a small claims action agaisnt Verizon and try to reach a settlement. But you need to keep current on your payments at least until you reach a settlement or until the court rules on your reasons to terminate the contract.
