Legal Question in Consumer Law in California
Company Liable for Vehicle Damage?
I have my car washed by a company that picks up my car from my office and drives it to their facility, next building over. After they dropped off the car, I went to check it out and noticed my car was parked, literally a few inches from the front parking curb. I also noticed there were deep scratches on my front bumper where the it would line up with the parking curb (my front bumper does not go over the parking curb). I did not see the driver hit the curb, but I did report it to them. They denied that they hit the parking curb while returning the car and have refused to pay for any damages. Do I have a case?

Re: Company Liable for Vehicle Damage?
If you didn't actually see them hit the curb with your car and you don't have a photograph or other evidence that there were no scratches on the bumper before they took your car to wash it, you might have a tough time making your case. However, the company should assume responsibility for your car when they take it from your possession to wash it. I'd say get an estimate to repair the damage and then send them a letter asking them to pay for it.
