Legal Question in Consumer Law in California

Company seems to be running a scam

Ipowerweb is my hosting company. For the past 5 years I have had more problems with them that I care to mention. Most recently when I called because I was not receiving emails, their employee instructed me to do a procedure to ''fix it''. What he failed to mention was that this would erase all emails I've sent or received for the past 5 years from my computer. I've had to spent $500 attempting to retrieve the info, and haven't been able to. I have tried for 20 hours on the phone to talk to a supervisor and each time I go through the story I'm told by an employee they will transfer me, and then they disconnect me. 5 times in one day last saturday this happened. WHAT CAN I DO? It makes me so mad that a company can avoid any responsibility. This is only the most recent in a string of nightmarish experiences that have cost me not only extraordinary amounts of time and money, but my sanity as well. I broke down crying last week when after 7 hours of phone calls, the final person promised to call me back if we ''got disconnected'' and then never did, of course. How do I get reimbursed for my $500 spent (AT LEAST) trying to fix their error? I have no money to spend on lawyers, unfortunately, or I would sue them in a second.

Re: Company seems to be running a scam

This is very simple. You need to sue them in Small Claims Court, which is part of your local County Court. You will have to bring in very specific credible evidence to support your claims for money damages -- eg, a detailed invoice for $500 to fix the computer and retrieve your emails. It seems to me that if what you say is true you should ask for recovery of the fees you have paid to Ipowerweb because their service was inadequate - they breached their contract to provide competent service.
