We spend weeks in law school Civil Procedure class on just such questions. The answers are VERY dependent on the exact facts and details of each case. There is no way to give a simple yes no answer, particularly with the nearly zero information you provide. You'll need to talk to a lawyer in person and go over it all, or just sue them in VA.
