Construction Contract completion over due
I hired a general contractor for a home improvment project on my house.
Permit issued date: 3/12/03
Permit pulled by contractor: 3/14/03
Contract line # 13
Time of construction to be 60 days (calendar) from day of issue of permit
Contract line # 18
Job completion rain delays or city delays to be recovered 1 for 1.
Construction time since Permit
Month Calendar days counted toward completion date
March 15
April 0 rain delays
May 15 (rain delays)
June 30
July 31
August 31
To date the project is more then 2 months overdue.
I already paid 9 out of ten payments. The 9nt payment was made on May,26,2003. Since than the contractor rarely works on the project, and he refuses to give us a construction schedule or completion date. The value of the uncompleted work is greater than the remaining last payment amount (based on the contract breakdown details).
How can I force him to complete the job?

First, is he a licensed contractor. Call the Contractor's Licensing Board. File a complaint with Board if he is a licensed contractor. CALL AN ATTORNEY TO HELP. 800-685-6950

First notify the State Contractors license board and file a complaint. Next if you can afford it, pay another to complete the job and if the amount is less than 5000, sue in small claims court. You may need the help of an attorney.
