consumer rights
on May 15th 2007 I paid online $2400.00 to Comcast Cable by mistake (my cable bill is $42.00/mo). After numerous calls and a visit to their local office they told me they would return my money in ~ 4 weeks, or the third week of June. It is Aug 11th. They said the check was mail on July 20th. I had not receive it. I asked to cancel that check and issue another. They don't want to. I'm a busy physician loosing time of work because of this. Can I sue?

Sure you can sue, but this is a small claims matter. You'll need to take time off from work to attend the trial. Some courts over evening hearings for smalls court.

Once you get a judgment and you haven't received your refund yet, you'd be entitled to pre-judgment interest. The sheriff could levy against its bank account if you know where it banks. Have you discussed this with your bank? Can it offer any help? Perhaps a letter from a lawyer would help.
