Legal Question in Consumer Law in California
Contracted Home Depot to install some windows for my home, the estimated time we were told was 4-6 weeks, the contract gives an estimate of 8-12 weeks and says if there is an issue they would contact us. At week 12-13 we contact them as we heard nothing and find out they need to order a different window because the manufacturer can't make them the size that was requested. We won�t be charged more for these different windows (normally they would cost more) but the wording in the contract makes it sound that if I refuse the new windows they can cancel the contract and I would still have to pay the cancellation charges. I want to find out if I have any leverage hear to negotiate, because the wording makes it sound like they can do almost anything they want and I can�t do anything about it.

It is always possible to negotiate, but it isn't really clearly what you are trying to accomplish. Do you want to cancel? Get a reduced price?
