Legal Question in Consumer Law in California

Credit card balance sent to collection while still making payments.

I closed my Diner's account over a year ago. Paid in full. I received a notice that there was a charge that did not make it onto my final bill. I have been paying that charge $600 off monthly. Either 100 or 50 a month. I just made my August payment of $50 August 1st. They accepted it. Now yesterday I received a letter from a collection agency informing they that Citicorp/Diner's turned it over for collection. Is this possible? I don't want this to screw up my credit...this collection. What rights do I have to stop this collection? I thought as long as I made a payment and Diner's continued to accept them this would not go to collection. Am I totally off?

No. You should get cancelled checks showing payments and then call the collection agency. Tell them that you have an agreement to pay with diners and that you have been paying. If you have a recent bill showing your payments and balance this should help.
