Customer pays for repair, but repair not completed

2 weeks prior to moving, I noticed my car was running bad, so I checked out my fluids. My coolant was completely gone. The resevoir was dry, so I filled it with 2 gallons of coolant. That too, disappeared then, returned a different colr. I took the car in and explained all that was happening. After checking, and doing thorough checks and tests, the mechanic explained that there wasn't anything wrong with the cooling system. 8 days later, my car overheated and broke down. Now there are $3000 worth of damage, that could have been prevented had the original problem been found. It seems my head gasket was due to be replaced, and after driving it for 8 more days it overheated the engine and warped the cylinder head. I feel the mechanic should have found the problem. Who's responsible?

Probably the mechanic, but check and confirm with a California lawyer.
