If i do a deed in lieu of forclosure, would this mean i would
not be responsible for the back tax that is owed on the property.
this is a private lender loan.

That is correct. The tax runs with the land. It would be good, however, to have the lender confirm that they understand that by taking a deed in lieu the tax lien remains.
