Legal Question in Consumer Law in California

Defamtion Lawsuit

I am having trouble with a pool contractor. I mentioned to him that I should write a letter to the editor of our local paper explaining the problems that I have been having. The pool contractor threatened me with a Defamation Lawsuit if I write the letter. If I only state the facts as they occurred in my letter, would I be found guilty in a Defamtion lawsuit?

Re: Defamtion Lawsuit

You can't be sued for telling true statements. However, the truth can be twisted to show a person in a "False light".

Besides, editors rarely print this type of negative letters. They print things regarding the government, public issues, etc. Not about bad merchants.

Work things out with the contractor or sue him if he has not performed to the specification of a contract.
