Legal Question in Consumer Law in California
Defining ''Commit'' and ''Sale''
I signed an agreement to receive hypnosis sessions. The contract was for 33 sessions. I prepaid for all of the sessions and was given a discount for doing that. I have been through 2 and do not want to continue. The only wording on the agreement I signed was:
''Advanced Payment Discount is only available for those sessions or programs committed to at your first visit or session. All sales final.''
I have 2 questions.
-Since the services for the remaining sessions have not been provided, at this point this is not a sale, right? It is a deposit? Therefore, the ''All sales final'' portion does not apply??
-What does the first sentence mean? Did I obligate myself to the future sessions or just agree that I would attempt the service?
Thank you for your assistance.
