Legal Question in Consumer Law in California

Diamond Ring

I purchased a non-GIA certified 'fancy yellow' VVS diamond ring a few months ago. I had the seller send the diamond to GIA to have it certified, and now that it's back, he's unwilling to let me take a look at the report. I'm going to have it independently appraised and have them get the GIA report # from the diamond, but I am afraid I may have been duped. What was sold to me as a 'fancy yellow' may actually be S-color and SI2. What legal recourse is available to me, and do I have a case?

Thanks!

Re: Diamond Ring

You already bought it knowing it was not certified and now you want some recource because it may not have the certification that was never promised? The expression caveat emptor was created for this specific situation! You could have asked for a certification before you bought it, but you chose not to. Now, it is probably too late unless you can prove some type of fraud.

I don't know what "fancy yellow" is but if the seller represented he was selling you a fancy yellow and it is NOT a fancy yellow, you have a case for sure!
