Legal Question in Consumer Law in California

donation legalities

I am starting an online marketing campaign called ''the spread the word campaign'' and it basically offers people free bible software in exchange for telling their friends about the same offer. I also have a secondary offer before they donwload the bible asking them to ''donate'' $5 or more to the ''spread the word campaign'' and also receive 2 other products that we actually ship to them. Is there any legalities involved with referring to this secondary sale as a donation?

It will most likely depend on how your "spread the word" campaign is organized. Have you applied for tax exempt status as a religious organization? Will this truly be a donation?
