Legal Question in Consumer Law in California

Dry Cleaners liable?

I took a king size down comforter to a dry cleaners and when I returned to pick it up I was given a twin size with a lot of stains on it. I am positive that was not my comforter but the owner insists it is mine. I believe there was a mix up, especially since when I picked it up, the ''ticket'' was not attached to any of the comforters they had on the floor. So he asked me which one was mine, and I took the one that looked like mine. When I got home and opened the bag, I realized it was a twin size and not a King size. On the last visit I made they showed me ticket that supposedly proved that the comforter belonged to me because it described the one that was there, but I pointed out that that was not my mom's name nor her phone number. I told her to call that person to verify, but she was being very irrate and irrational. Now she is accusing me of planning this and is offering to pay me $20 for a comforter that costs at least $100 for me to replace. Can you tell me if I have a case and if so what amount are they liable to pay? Is there a percentage or how is that determined. Thank you.

Re: Dry Cleaners liable?

This is a case of "I said" "He said". Your best bet is to sue in small claims court and let the judge decide.
