Being Dunned for payment to a free newsletter

One of my employees was called by Progressive Business Publications and asked if he wanted a free newsletter about his payroll job. He agreed and per their collection agency and again, per thier collection agency,gave his birthdate. Per the employee he never gave his bithdate and has never received the newsletters. The collection agency (International Credit Reciovery Inc., is now saying the company (Atkinson-Baker, Inc.) has to pay for this as he did not opt out of receiving the newsletters on time. Are we required to pay this?

It sounds like a scam to me.
