Legal Question in Consumer Law in California

eBay purchase

On June 1, 2003 I bought item on eBay for $2500. http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=2932014839

It was presale auction and seller ask buyers to wait 4-6 weeks for delivery. Please, take a llok at presale auction rules:

Now past 11 weeks since auction was ended and seller still delay shipping date. Today I've sent e-mail to seller with question when I'll get my item. She asked me to wait till end of this month. I don't want my money back. I wait long time and I want to get my item. What can I do to receive my item? Please, help me!!!

1st. Report this to e-bay.

2nd. File a criminal complaint with the local authorities where the seller lives.
