Legal Question in Consumer Law in California

I entered into a contract with Priceline.com for a rental car from Avis from June 20th thru July 4th. My sister passed away suddenly and I needed to change my plane reservation on Southwest from the 20th to May 28th. No problem. Tried to cancel my car reservation for the 20th through Avis and they directed me to Priceline. I informed Priceline of my sisters death, offering to supply a death certificate, and was told there was nothing they could do for me. Do I have any recourse?

Is there any breavement clause that will help me cancel the reservation and refund my money?

While I'm sorry for your loss, PL does allow you the option to buy trip insurance, otherwise the sale is final.

I am sorry for your loss. Here's what Priceline's website says:

Priceline.com rental car reservations are non-changeable, non-endorsable, non-transferable and non-refundable;

However, they also state this:

We may, on an exception basis and at the request of the customer, waive the restrictions identified above after the rental has been reserved. We may, in our discretion, impose additional obligations and/or fees in connection with any such waiver.

I would call back, ask to speak with a supervisor and point them to this policy that allows them to waive the non-refundable restriction.
