Legal Question in Consumer Law in California

Extended Warrantee Fraud or Misrepersented

I was sold an extended warrantee last year on my computer. A month before it is to expire I need repair on the hardware. I was told by the Case Manager of the company that the warrantee was sold to me in error and that they can't fix PCs that are 3 years old. The warrantee states if can't be fixed they have to replace it and they refuse to do anything. Was it fraud for them to sell me a warrantee that is not good?

Probably not fraud, but probably breach of warranty. If you were given a warranty that says you get a replacement if unable to repair, then that is what you get. If the manufacuturer does not honor the warranty that is the seller's problem, not yours. You may sue the seller in small claims court for breach of warranty.

It also breaks consumer protection laws. If they've been doing the same thing to other consumers, you may be able to be a class representative, and file a class action over this. Feel free to contact at my private email with more details.
