Legal Question in Consumer Law in California

Fliers on my doorstep/windshield - Is that litter legal?

I have posted a ''no fliers, no advertisements, no

litter!'' sign in front of the house I rent and the

fliers have not stopped. I place a call every time I

get a new one. Can I press charges for littering?

Re: Fliers on my doorstep/windshield - Is that litter legal?

Thanks for your inquiry. Litter is normally an offense prosecuted by your local municipality, not individuals, although it wouldn't hurt to advise them of the problem. You can also file a lawsuit based upon "nuisance", and can receive the depreciation as to any property you own, as well as the cost to have someone remove the fliers. The problem, as I see it, is that many of the companies that place the flyers often are not very solvent, so if you get a judgment, you may not collect much. At least you'll make the point.
