Legal Question in Consumer Law in California
Food contamination
My son is 5 years old. He suffers from severe allergies to milk and eggs. He ate a soy Yogurt and had an allergic reaction (E/R visit and 4-5 hour stay for observation). The company had the yogurt tested and milk was found in the yogurt (cross contamination). Should I file a lawsuit against the company, and if so, should I include the point they should be disclosing the equipment they use for soy, is also used to make regular yogurt (milk), which they do not disclose on the label.

You should consult with an attorney. You have a products liability case. This is a more specialized area of the law. In addition, any settlement involving a minor must be approved by a Judge. There are a lot of issues going on with this case that require the expertise of an attorney.
In addition, this may be the basis of a class action lawsuit against the manufacturer. You may want to consider a consultation with a class action attorney.
If you do not know one, I can recommend an attorney for either aspect for you if you would like a referral as I do not handle that type of work.

Re: Food contamination
Good morning. I hope your son is doing better. You should certainly pursue this as you and your son should be adequately compensated for what you have been through. In addition, it is very important that this company alerts other consumers and prevents future cross contamination so that more people are not harmed. It does sound as though you have already contacted the company, have they offered you any compensation or informed you of any changes they will make to prevent this in the future?
I would be willing to discuss your case to see how I may be of assistance. You will notice that I am located in downtown San Diego. I have experience in products liability and in representing minors in personal injury cases.
I offer prospective clients an initial consultation of 30 minutes for free.
I look forward to speaking with you.
Yours truly,

I hope you and your son are doing well. I have a daughter who has allergies and I totally understand what you have gone through. Actually, I am investigating a similar matter for another client. I am not sure that we are dealing with the same company or not. But I would like to talk to you about this. You have various claims. Taking action will compensate your family and as well as helping other families who may face the hardship.
