''As Is'' furniture Delivered Damaged
I bought furniture in ''As Is'' condition from a show room. At the time of purchase there was no visible damage the the merchandise.
My credit card was charged for the furniture, it was then delivered 3 weeks later. When delivered a pane of glass on the furniture was cracked. I wrote damaged on the shipping claim check and called the retailer where I bought it from according to their claim directions which read (Call within 3 days, and they will give me a resoution within 5 days)
I have been waiting for a response on what they will do for 3 months now. They have never called me back, and anytime they say they will fix the glass when confronted they will not put it in writing.
Question is, what are my options? Are they in the wrong or am I just not giving them enough time to fix the problem? What is an approriate time frame in allowing this to continue. I have logged all calls to them since this all started.

Because it was was not broken when you bought it, you should try small claims court.
