Legal Question in Consumer Law in California
I had my furniture re-upholstered last September. I purchased slip covers from Bed Bath & Beyond to keep all the furniture in pristine condition for family and friends. I removed the slip covers 2 months ago and found the dye in the covers stained my furniture. There was no indication on the covers or the packaging that their materials would bleed onto the fabric it was to cover. The insurance carrier told me they would pay for the cleaning and it could be done with soap and water as per the slip designers. I took them to a commercial cleaner, and he had doubts prior to the attempt, but gave the collage try so to speak. Soap and water will not work, and harsh chemicals must be used to remove the stains. This also removes the original coloring of the fabric. The only thing left to do is re-upholster again. Insurance wants to pay me the price I paid for the upholstering, minus 5%, saying I used the furniture for 6 months. That is not enough...I will still have another 2 months waiting for the re-upholstering, and will have the aggravation of taking the furniture back to the shop and picking the pieces up another time when complete. Also we may not be able to get the same fabric as has been ruined on my couch, love-seat and arm chair. What would be reasonable to expect and ask from these Knuckle-Heads. JD
