Legal Question in Consumer Law in California
Goods different from the original ones which have been dealing with
Several days ago, my friend and I purchased an used camera
from the person who lives in San Diego.
He sent this camera through USPS Express. There should be one Leica M3 camera body, two lenses and leather camera case in that package. However, when we receieved this package and opened it, we found the things which we dealed with the seller in the package weren't right.Actually, there was only one old camera in that box. We informed him about this situation. He insisted that there was something wrong during the delivery process. The camera and other stuffs have been changed. We asked him turn our money back,
but he didn't want. Instead, he wanted us to claim the insurance which he made while sending it and so that we can compensate our loss from this trade.
The total amount we paid is US$847. We just wonder if there is anyone know about the consumer's law or rights of U.S. and can ask the money back. Of course, those money will belong to the person who can successfully ask the money back.
We will offer all the evidence which this trade was going.
We do all these things just because we don't want this dishonet event happens to other innocent people who believe in the Web.trade.

This sounds like a scam by the seller. Selling one thing, shipping another and telling the buyer to file a claim with the insurance. Sue the seller in small claims court in San Diego. Then notify the DA in san diego.
